Azad Hind Fauj, Second World War, Punishment of Convicts, Indian Army Act 1911

Abstract

After the defeat of Japan in the Second World War, the soldiers of the Azad Hind Fauj also had to surrender. After that, the British government decided to bring these war prisoners to India and prosecute them, but in view of the opposition of the public, the chief officers of the Azad Hind Fauj were prosecuted. Prominent among them were Captain Shah Nawaz Khan, Prem Kumar Sehgal and Lt. Gurbaksh Singh Dhillon was the chief. To save these soldiers, some lawyers were appointed by the Congress and major parties, in which Bhola Bhai Desai was prominent. The trial of these accused started on November 5, 1945 and lasted for about two months. On hearing the case by the court, these accused were found guilty and expelled for life, dismissed from the job and ordered forfeiture of salary and arrears. But in view of public pressure, the Viceroy removed the punishment of exile for life against these accused.
